Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of potarix.com, Potarix services, and Potarix messaging programs. By using a service, you agree to the portions of these Terms that apply to that service. If you do not agree, do not use the service.

The Potarix service

Potarix provides business lead-intelligence and related research services, including lists of newly formed and recently funded companies filtered to customer criteria. We may also provide private automation and messaging tools to authorized users. Service details, pricing, and deliverables may be described on the site, in an order form, or in a separate agreement.

Potarix Personal AI Assistants SMS program

The Potarix Personal AI Assistants program provides authorized users with conversational assistant replies, requested task results, reminders, and system-status notifications through SMS. Messages may identify an assistant as OpenClaw or Hermes while identifying Potarix as the program operator.

Participation is limited to mobile numbers that an authorized user has manually added to a private allowlist and affirmatively enrolled for the program. Consent applies only to this Potarix program and is not transferable to another company or campaign. Consent to receive SMS messages is not a condition of purchasing any Potarix product or service.

Delivery is subject to carrier availability and is not guaranteed. After opting out, you must provide new affirmative consent before messages can resume. Our use of mobile information and messaging consent is described in the Potarix Privacy Policy.

Your responsibilities

You agree to provide accurate information, protect access to your account and devices, and use Potarix lawfully. You may not use the service to send unlawful, deceptive, abusive, unsolicited, or unwanted communications; interfere with the service; evade consent or suppression controls; or access another person's data without authorization.

Customers using Potarix business data are responsible for their own outreach and for complying with applicable privacy, email, telemarketing, and consumer-protection laws. Unless a separate agreement says otherwise, you may not resell or redistribute Potarix-provided lists outside your organization.

Billing and cancellation

Paid subscriptions renew at the agreed interval unless canceled. Unless an order form or separate agreement states otherwise, cancellation takes effect at the end of the current billing period and amounts already paid are non-refundable to the extent permitted by law.

Data and service availability

Potarix uses reasonable efforts to provide useful, current information, but third-party and public-source data can be incomplete, delayed, or inaccurate. We do not guarantee that every record, message, result, or service feature will be uninterrupted, current, or error-free.

Intellectual property

Potarix and its licensors retain their rights in the site, service, software, branding, and materials. Subject to these Terms and any applicable agreement, Potarix grants you a limited, non-exclusive, non-transferable right to use the service for your internal business purposes.

Warranty disclaimer

To the fullest extent permitted by law, the service is provided "as is" and "as available." Potarix disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing or usage of trade.

Limitation of liability

To the maximum extent permitted by law, Potarix will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or business opportunities. Potarix's total liability arising from the service will not exceed the amount you paid Potarix for the applicable service during the 12 months before the event giving rise to the claim.

Suspension and termination

We may suspend or terminate access when reasonably necessary to protect the service, comply with law or carrier requirements, prevent harm, respond to nonpayment, or address a material breach of these Terms. Provisions that by their nature should survive will remain in effect after termination.

Changes to these Terms

We may update these Terms as our services or legal obligations change. We will post revised Terms here and update the effective date. Continued use after an update becomes effective constitutes acceptance of the revised Terms.
